Terms of Service

GrazieChef is a software-as-a-service (SaaS) platform that lets operators of restaurants, pizzerias, pubs, bars and similar venues manage tables, digital orders, the kitchen (KDS), reservations, menus and staff via web browser and mobile devices.

The Service is provided by Alexix Capurro, acting as an individual ("we", "the Provider"), operating as an occasional professional service with no VAT registration. The terms "user", "you", "operator" refer to the person or entity accessing the Service.

To use GrazieChef you need to create an account with a valid email address. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.

You must be at least 18 years old to register. Registering on behalf of a third party without explicit authorization is not permitted.

Credentials must not be shared with unauthorized people. If you suspect unauthorized access, notify us immediately at hello@graziechef.com.

GrazieChef offers a free Free plan and paid plans (Starter, Pro). Each plan's features are described on the pricing page.

Prices are inclusive of VAT for Italian consumers; for operators with a VAT number, VAT will be applied per applicable regulations. Payments are processed by Stripe. We do not store payment card data.

Subscriptions renew automatically at the end of each billing period (monthly or annual). You can cancel auto-renewal at any time from your account settings or by writing to hello@graziechef.com.

Free trial: new accounts get a 14-day trial of the Pro plan. No credit card required for the trial. At the end of the trial, the account automatically moves to the Free plan unless you explicitly upgrade.

Refunds: we do not offer refunds for partial billing periods already invoiced. In case of serious service issues attributable to GrazieChef, we will consider refunds or credits on a case-by-case basis.

You agree not to use GrazieChef to:

• Engage in illegal or fraudulent activity.
• Collect end customers' personal data in violation of GDPR or applicable law.
• Reverse engineer, decompile, or attempt to extract the source code.
• Intentionally overload our servers with automated requests (scraping, bots, DoS attacks).
• Sell, transfer or license access to the Service to unauthorized third parties.
• Create multiple accounts to bypass the Free plan's limits.
• Upload unlawful, pornographic, defamatory content or content that infringes third-party rights.

Violating these rules may result in account suspension or termination without a refund.

Data you enter into GrazieChef (menus, orders, reservations, staff data) remains your property. GrazieChef claims no ownership rights over this data.

You grant GrazieChef a limited, non-exclusive, non-transferable license to process your data solely to provide the Service (storage, backup, sync, display).

Before closing the account, the user can download a full export of their data from the settings on their own; on closure the data is permanently deleted (subject to legal retention obligations).

GrazieChef's software, design, trademark and documentation are the exclusive property of the Provider and are protected by copyright and intellectual property law.

We aim to guarantee service availability of 99.5% or higher per month. Availability may be temporarily reduced for scheduled maintenance (announced at least 24 hours in advance) or for events beyond our control (AWS/Supabase outages, DDoS attacks, force majeure).

We do not guarantee the Service will be available uninterrupted, error-free, or free from data loss. We recommend making periodic backups of critical data.

To the maximum extent permitted by applicable law:

• GrazieChef is provided "as is" without warranties of any kind, express or implied.
• We are not liable for data loss, loss of profit or indirect damages arising from use of the Service.
• Our total liability to you will not exceed, in any case, the amount you paid for the Service in the last 12 months.
• We are not responsible for errors made by users when entering orders, prices or operational data.

These limitations do not apply in cases of intent, gross negligence or violations of consumer protection laws.

By the user: you can cancel your account at any time from Settings → Danger zone (venue owner) or by writing to hello@graziechef.com. Cancellation is immediate and permanent: the subscription is cancelled right away and the venue's data is deleted with no possibility of restoration, so export it first if you need it.

By GrazieChef: we may suspend or cancel an account in the event of: violation of these Terms, non-payment for more than 30 days, unlawful activity or activity that poses a security risk to the platform. If suspension is not attributable to the user, we will give at least 30 days' notice except in emergencies.

We may modify these Terms. In the event of material changes, we will notify users by email with at least 30 days' notice. Continued use of the Service after the effective date constitutes acceptance of the new Terms.

If you do not agree to the changes, you may cancel your account before the changes take effect.

These Terms are governed by Italian law. For any dispute that cannot be resolved amicably, the parties elect the Court of Milan as the exclusive competent jurisdiction.

Consumers benefit from the mandatory protections provided by Italian law and EU consumer protection regulations.
